Deposit Terms

1. Purpose of the deposit

The deposit secures the date and time of the session for the client, compensates the Artist for time spent on design preparation and for consumables, and is credited towards the final cost of the work.

2. Full refund

The deposit is refunded in full if notice of cancellation is received by the Artist no later than 14 (fourteen) calendar days before the scheduled session date. Notice must be given in writing — by WhatsApp message to +48 531 609 827 or by email to [email protected]. The date of notice is the date the message is received by the Artist.

3. Cancellation fewer than 14 days before the session

If notice of cancellation is received fewer than 14 calendar days before the session date, the deposit is non-refundable. This applies regardless of the reason for cancellation, including but not limited to client illness, changes in personal or work commitments, transport problems, weather conditions, or other unforeseen circumstances affecting the client.

4. Booking confirmation

A session is booked only after the Artist sends the client written confirmation that the deposit has been received, via WhatsApp or email. Until such confirmation is received, the requested date is not held for the client and may be offered to another client. The deposit must be paid to the account or payment details provided by the Artist in personal correspondence; a transfer sent to any other account or recipient does not constitute a valid deposit.

5. Client readiness for the session

The client is solely responsible for being prepared for the session. This includes, but is not limited to:

• sobriety (no alcohol or recreational drugs);
• absence of recent tanning, sunburn or skin damage in the area to be tattooed;
• timely notification to the Artist, no later than 7 (seven) calendar days before the session, of any chronic conditions, allergies, use of blood-thinning medication, pregnancy, or other contraindications to tattooing.

If on the day of the session it becomes apparent that the client does not meet these requirements and the tattoo cannot be performed or would present a health risk, the Artist reserves the right to refuse the session. In such case, the deposit is non-refundable.

6. Late arrival

Arrival more than 30 (thirty) minutes after the scheduled start time without prior notice to the Artist gives the Artist the right, at the Artist's sole discretion, either to shorten the session within the remaining available time or to cancel the session entirely. If the session is cancelled due to late arrival, the deposit is non-refundable.

7. Scope and content of the work

The deposit relates to the design, size, placement and overall scope of work agreed between the parties before the session date. If the client initiates a substantial change to the design, size or placement on the day of the session that requires additional preparation, the Artist may reschedule the session to allow time for the agreement and preparation of a new design. In such case, the deposit is retained and credited towards the cost of work on the rescheduled date; additional preparation time for the new design may be charged separately by agreement of the parties.

8. No-show

If the client fails to attend the session on the scheduled date and at the scheduled time and has not given the Artist notice of cancellation or rescheduling before the start of the session, this is treated as a no-show. In the event of a no-show, the deposit is non-refundable and the booking is cancelled automatically.

9. Cancellation by the Artist

If the session is cancelled at the Artist's initiative (in particular, due to illness, force-majeure circumstances, technical reasons or other circumstances outside the Artist's control), the client may elect, at the client's choice, either to receive a full refund of the deposit or to reschedule the session to a new mutually agreed date, at no additional cost.

10. Refund procedure

Refunds of any deposit refundable under these Terms are processed using the same payment method used to pay the deposit, within 7 (seven) business days after the Artist's written confirmation of cancellation. The amount refunded is the amount actually received by the Artist; any currency-conversion differences or losses — whether on the original transfer or on the refund — as well as bank fees and payment-system fees (PayPal, Wise, Revolut, etc.) are not reimbursed.

11. Statutory right of withdrawal (EU clients)

The statutory 14-day right of withdrawal granted to consumers under Directive 2011/83/EU does not apply to this contract, pursuant to the exception in Article 16(l) of that Directive, because a tattoo session is a service provided on a specific agreed date. By sending the deposit, the client expressly consents to the immediate commencement of the service (date reservation and design preparation) and knowingly waives that statutory right.

For the avoidance of doubt, the 14-day cancellation window in Section 2 is a contractual term granted by the Artist and is independent of, and does not substitute for, any statutory right of withdrawal.

12. Governing law, dispute resolution, language

These Terms are governed by the laws of the Republic of Poland. The parties shall first attempt to resolve any dispute arising in connection with these Terms through negotiation; failing agreement, the dispute shall be submitted to the courts having jurisdiction over the Artist's principal place of business in Poland. These Terms are published in four languages: English, German, Russian and Polish. In the event of any discrepancy between the language versions, the English version prevails.

13. Changes to the Terms

The Artist may amend these Terms. The version applicable to a given booking is the version published at alex666cold.com at the time the deposit for that booking is paid; subsequent amendments do not apply retroactively to bookings for which a deposit has already been received.
